Article 1 – Definitions
Additional Agreement:
An agreement whereby the consumer acquires products or services in connection with a distance contract, supplied by Whitmore Boutique or a third party under arrangements with Whitmore Boutique.
Withdrawal Period:
The period during which the consumer may exercise the right of withdrawal.
Consumer:
A natural person who is not acting for business, trade, or professional purposes.
Day:
A calendar day.
Long-term Contract:
A contract relating to recurring delivery of goods or services over a set period.
Durable Medium:
Any tool that enables the consumer or business to store information for future reference (e.g., email).
Right of Withdrawal:
The consumer’s right to withdraw from a distance contract within the withdrawal period.
Distance Contract:
An agreement concluded within the framework of an organised system for distance selling.

Article 3 – Applicability
These general terms apply to every offer made by Whitmore Boutique and every distance contract concluded between the consumer and Whitmore Boutique.
Before a distance contract is completed, these terms will be made available to the consumer in a way that allows them to be stored on a durable medium.
If additional product or service terms apply alongside these general terms, the consumer may rely on whichever provision is more favourable in the event of inconsistency.
Article 4 – The Offer
If an offer has limited validity or specific conditions, this will be clearly stated.
All product descriptions and images aim to represent items as accurately as possible.
Obvious errors or mistakes do not bind Whitmore Boutique.
Every offer clearly outlines the consumer’s rights and obligations.
Article 5 – The Agreement
The agreement is formed when the consumer accepts the offer and meets the stated conditions.
Whitmore Boutique will confirm receipt of an electronic order without delay. Until this confirmation is issued, the consumer may cancel the order.
Whitmore Boutique will take reasonable technical and organisational measures to ensure secure data transmission and a safe shopping environment.
Whitmore Boutique reserves the right, within legal limits, to assess whether the consumer can meet payment obligations. Orders may be declined or accepted under additional conditions if reasonable grounds exist.
Article 6 – Right of Withdrawal
Consumers may withdraw from the agreement within 30 days of receiving the product, without providing a reason. Whitmore Boutique may request feedback but cannot require justification.
Article 7 – Consumer Obligations During the Withdrawal Period
Products and packaging must be handled with care.
The consumer may inspect the item only to the extent necessary to determine its nature and characteristics.
When exercising the right of withdrawal, the product must be returned with all accessories — ideally in its original packaging.
Article 8 – Exercising the Right of Withdrawal & Costs
The consumer must notify Whitmore Boutique of their intent to withdraw within the withdrawal period.
This may be done in writing or via email.
Return postage costs are the responsibility of the consumer.
Article 9 – Obligations of Whitmore Boutique Upon Withdrawal
Whitmore Boutique will acknowledge receipt of withdrawal notices promptly.
Refunds will be processed after the returned product has been received and inspected.
Article 10 – Exclusions to the Right of Withdrawal
Withdrawal rights may not apply to products that are:

custom-made or personalised

of a personal nature

unsuitable for return due to their nature

liable to deteriorate quickly

subject to price fluctuations beyond our control

delivered as single issues of magazines

audio/video/software with broken seals
Article 11 – Prices
Prices will not increase during the offer period, except for VAT/GST adjustments.
Whitmore Boutique may offer variable pricing for items affected by market fluctuations, where clearly stated.
All prices include GST where applicable.
Article 12 – Conformity & Warranty
Whitmore Boutique guarantees that products conform to the agreement, description, and applicable Australian consumer law.
Additional warranty does not limit statutory rights under Australian Consumer Law (ACL).
Article 13 – Delivery & Performance
Whitmore Boutique will take great care with the processing and delivery of orders.
Delivery will be made to the address provided by the consumer.
Orders will be shipped as soon as possible and always within 30 days unless otherwise agreed.
If a delay occurs, the consumer will be informed and may cancel the order at no cost.
Risk transfers to the consumer once the parcel is delivered.
Article 14 – Ongoing Contracts: Duration, Termination & Renewal
Indefinite contracts may be terminated with one month’s notice.
Fixed-term contracts may be ended at the agreed expiry date with up to one month’s notice.
Automatic renewal beyond the agreed term is not permitted.
Article 15 – Payment
Unless stated otherwise, payment must be made within 14 days of the agreement.
Consumers cannot be required to pay more than 50% upfront.
Late payments may incur statutory interest and reasonable recovery costs.
Article 16 – Complaints Procedure
Complaints must be submitted in writing and described clearly.
Whitmore Boutique aims to respond within 14 days.
If more time is needed, consumers will be notified of the expected resolution timeframe.
Article 17 – Governing Law & Disputes
All agreements between Whitmore Boutique and consumers are governed exclusively by Australian law.
Disputes will be handled by the competent court in the consumer’s state or territory, as required under Australian Consumer Law.
Article 18 – Additional Provisions
Any additional or deviating provisions must not disadvantage the consumer and must be provided in writing or stored on a durable medium.
